Terms & Conditions
Effective November 2, 2026
Sigma Transport Holdings and its Affiliated and Subsidiary Companies
Effective Date: November 2, 2026
Last Updated: November 2, 2026
Important Notice About Disputes
These Terms include an individual arbitration agreement, restrictions on class and representative arbitration, and provisions selecting courts in Allegheny County, Pennsylvania. Read those provisions carefully before accepting.
When you affirmatively accept the arbitration agreement and it lawfully applies to a dispute, that dispute will generally be decided by an arbitrator instead of a judge or jury.
These provisions apply only where there is a valid, enforceable agreement. Exceptions for certain employment matters, transportation workers, government proceedings, and other protected claims appear below.
Agreement to these Terms does not, by itself, authorize text messages, automated calls, prerecorded calls, or marketing communications.
1. About These Terms
These Terms & Conditions (“Terms”) describe the rules governing the covered websites and online services of Sigma Transport Holdings and its affiliated and subsidiary companies, collectively referred to as “Sigma,” “Sigma Companies,” “Company,” “we,” “us,” or “our.”
The covered entities are:
- Sigma Transport Holdings
- Sigma Transport
- Sigma Transport-BING
- Sigma Transport-Lehi
- Sigma Continental
- Sigma Fleet Services
These Terms apply to the following websites and their covered pages and features:
- SigmaFleetServices.com
- SigmaTransport.com
- SigmaContinental.com
- DriveForSigma.com
- Drive4Sigma.com
- Sigmatransport.io
References to a “website,” “our websites,” or “online services” include the applicable websites listed above and any associated features expressly governed by these Terms.
“You” and “your” refer to the person or organization using those services.
Each Sigma entity remains a separate legal entity. The company responsible for a particular employment opportunity, service, or transaction is the entity identified in the relevant application, agreement, disclosure, or transaction record. These collective definitions do not, by themselves, make every Sigma company a party to every transaction or responsible for another entity’s obligations.
2. Acceptance and Scope
Our websites provide information and tools relating to transportation, logistics, fleet services, recruiting, employment applications, and other business activities.
Covered features may include:
- Job listings and employment application forms.
- Applicant accounts and identity verification.
- Recruiting correspondence and interview scheduling.
- Business inquiries and customer support.
- Electronic forms, documents, and acknowledgments.
- Authorized email, telephone, and text communications.
- Other online functions identified as subject to these Terms.
Where a service requires contractual acceptance, you accept the applicable Terms through the designated acknowledgment or acceptance control.
Simply reading public website content does not establish acceptance of the arbitration agreement or its related waivers.
If you decline Terms required for a particular service, discontinue use of that service.
Separate employment agreements, customer contracts, transportation agreements, collective bargaining agreements, platform terms, and other specific agreements may also apply. A valid agreement specifically governing a relationship or transaction takes priority over these Terms where the provisions conflict, subject to controlling law.
3. Sigma’s Relationships With Other Businesses
Sigma companies may perform transportation, pickup, delivery, logistics, maintenance, and related work for other businesses, including FedEx-affiliated organizations.
A reference to FedEx or another customer does not mean that an applicant or Sigma employee is employed by that customer. Employment documents identify the applicable hiring entity.
Names, logos, and trademarks belonging to other organizations remain their property. Website access does not create an employment, agency, partnership, or joint venture relationship between a visitor and any third party.
4. Age and Eligibility
Our online services are primarily intended for adults seeking employment, business information, or services.
The websites are not directed to children under 13. Children under 13 must not independently register accounts, submit applications, or provide personal information through our websites.
Visitors ages 13 through 17 may view public information where permitted by law and with any required involvement of a parent or legal guardian.
Job eligibility depends on the requirements of the position. Some roles require a particular minimum age, a valid driver’s license, commercial driving qualifications, or other credentials.
If we discover that a child under 13 submitted personal information without legally required authorization, we will take appropriate steps, including deletion when required. A parent or guardian may contact us using the information at the end of these Terms.
5. Responsible Website Use
Use our websites only for lawful purposes and within the access permissions provided to you.
You must not:
- Submit information you know is false, fraudulent, or materially misleading.
- Misrepresent your identity or act as another person without authorization.
- Access accounts, systems, records, or networks without permission.
- Bypass authentication, security, or access restrictions.
- Introduce malicious software or harmful code.
- Disrupt website operations or interfere with another user’s access.
- Use unauthorized automated collection or extraction tools, except where protected by law.
- Obtain or disclose another person’s personal information without authority.
- Infringe intellectual property or other protected rights.
- Use our services to threaten, harass, unlawfully discriminate, or cause unlawful harm.
- Exploit technical defects or security vulnerabilities.
- Conduct activities prohibited by applicable law.
We may investigate suspected misuse, restrict access, and pursue available remedies when reasonably necessary and legally permitted.
6. Accounts and Verification
Some services require an account or verification of your identity.
Keep account details accurate and protect passwords, verification codes, and other access credentials. Do not provide credentials to unauthorized persons.
We may use email confirmation, one-time codes, multifactor authentication, or similar safeguards. Report suspected unauthorized access promptly.
Access may be temporarily restricted while we investigate a security concern. An account gives you permission to use designated features; it does not give you ownership of our software, systems, databases, or records.
Account verification messages are separate from optional recruiting text messages and remain subject to applicable communication requirements.
7. Job Listings
Our websites may describe current or anticipated positions in driving, delivery, supervision, fleet operations, administration, and other business functions.
Listings may change as business needs develop. Descriptions of pay, benefits, schedules, locations, and qualifications are informational and do not constitute a binding employment offer.
We may revise or close a posting in accordance with applicable law. Applying does not guarantee an interview, offer, or position.
8. Application Information
Applications may be submitted through the recruiting features available on a covered website or through an authorized application provider.
Depending on the role, requested information may include:
- Legal name, address, and contact information.
- Work eligibility information.
- Employment and education history.
- References and professional qualifications.
- Driver’s license or commercial driver’s license details.
- Endorsements, certifications, and driving experience.
- Availability and scheduling preferences.
- Other information relevant to a lawful hiring evaluation.
Provide information that is accurate and complete to the best of your knowledge. Do not knowingly misstate your identity, experience, credentials, or license status.
We may request clarification or supporting documents. Application records are handled under applicable retention requirements and the relevant Privacy Policy.
9. Driving Positions and Safety Qualifications
Driving roles may involve requirements established by federal or state transportation laws, including applicable Department of Transportation and Federal Motor Carrier Safety Administration rules.
Depending on the position, qualification reviews may address licensing, experience, medical qualifications, driving history, safety performance, and customer requirements.
These Terms do not replace required driver qualification forms, testing notices, disclosures, authorizations, or other regulatory procedures.
Hiring and qualification decisions remain subject to applicable law.
10. Screening and Background Reports
Where permitted, we may use qualified providers to verify employment, references, licenses, certifications, driving records, and other information relevant to a position. Screening may also include criminal history information where its use is lawful.
Consumer reports obtained for employment purposes will be handled under applicable requirements, including the Fair Credit Reporting Act.
Applicants will receive separate disclosures, authorization requests, and adverse-action notices when required.
Accepting these Terms does not authorize a background check that requires a separate disclosure or consent.
11. Equal Opportunity and Application Assistance
Sigma conducts recruiting and employment activities subject to applicable equal employment opportunity requirements.
We consider requests for reasonable accommodation as required by law. If you need assistance accessing a job posting or completing an application, contact us using the details below.
These Terms do not restrict protected complaints, accommodation requests, or other employment rights.
12. Employment Relationships
Website statements, interviews, recruiting messages, application submissions, preliminary approvals, and onboarding activities do not independently create an employment contract or guarantee employment.
An offer may depend on lawful conditions, including verification of qualifications and completion of required documents.
These Terms do not replace signed employment agreements, employee handbooks, required workplace notices, or rights that cannot legally be waived.
13. Electronic Documents and Signatures
Some features allow you to submit, acknowledge, or sign documents electronically.
Where the law permits and the necessary consent exists, an electronic record or signature may have the same effect as a paper document or handwritten signature.
We may keep document versions, timestamps, acknowledgment records, and related audit information. Separate consent will be requested when required.
Review each document before accepting or signing it.
14. Communications With Sigma
We may communicate through authorized channels, including email, telephone, account notifications, and text messages.
Communications may concern applications, interviews, qualification reviews, onboarding, account security, customer support, transportation activities, or other relevant business matters.
Providing contact information does not authorize every type of communication.
Acceptance of these Terms alone does not supply consent for text messages, automated calls, or artificial or prerecorded voice calls when separate consent is required.
15. Optional Employment Text Messages
Program purpose
Sigma may offer optional employment messaging programs for application updates, interview arrangements, recruiting questions, qualification information, document requests, onboarding instructions, and applicant support.
The enrollment disclosure identifies the Sigma entity or messaging program sending the texts. Listing multiple Sigma companies in these Terms does not expand a person’s consent beyond that disclosure.
Employment messaging consent does not automatically authorize unrelated advertising.
Enrollment
Where offered, enrollment requires a separate, voluntary action, such as selecting an optional SMS checkbox that is unchecked by default.
The enrollment disclosure describes the sender, message purpose, expected frequency, potential charges, and available help and cancellation methods.
You do not have to agree to text messages to apply or be considered for employment.
Entering a phone number, submitting an application, or accepting these Terms does not, on its own, enroll you.
Frequency and charges
Message frequency varies. Message and data rates may apply.
The number of messages depends on recruiting activity and your application stage. Sigma does not charge a separate subscription fee for employment texts. Your wireless provider may charge under your service plan.
Stopping messages
Reply STOP to a program text to unsubscribe.
We will process valid cancellation requests according to applicable requirements. You may receive a permitted confirmation of your request.
Stopping texts does not automatically withdraw your application or end employment consideration. We may continue communicating through other lawful channels.
Getting help
Reply HELP to a program text for assistance, or email info@sigmacontinental.com.
Delivery limitations
Wireless carriers are not responsible for delayed or undelivered messages.
Delivery may be affected by network conditions, device settings, carrier filtering, and other circumstances. Immediate or uninterrupted delivery is not guaranteed.
Your mobile number
Provide a number you are authorized to use. Notify us if it changes, is disconnected, or is no longer under your control. We may stop messages to numbers identified as invalid or reassigned.
Messaging information and privacy
We may retain phone numbers, enrollment records, consent details, message activity, and cancellation records to operate the program, document preferences, and meet legal obligations.
We do not sell or share SMS enrollment information or personal information with third parties or affiliates for their marketing or promotional purposes. Mobile numbers, messaging opt-in records, and consent are not shared for another party’s independent marketing.
Authorized providers may process this information only as necessary for delivery, support, security, and program administration under appropriate contractual safeguards.
The applicable Privacy Policy provides further information about personal information practices.
Program changes
We may revise, pause, or discontinue a messaging program. When a change requires notice or renewed consent, we will follow the applicable requirements.
16. Telephone Calls and Marketing
Sigma and authorized providers may place calls or send communications when legally permitted and supported by any necessary consent.
Relevant subjects may include recruiting, onboarding, employment administration, customer assistance, transportation services, and shipment or load updates.
Automated dialing and artificial or prerecorded voice technologies will be used only where authorized by applicable law and any required consent.
Submitting an application, providing a number, or accepting these Terms is not blanket permission for automated calls, prerecorded messages, or telemarketing.
Marketing consent must be obtained independently when required. It is not a condition of applying for employment or receiving Company services.
You may revoke consent through reasonable methods recognized by applicable law. Communications remain subject to applicable calling, messaging, and Do Not Call requirements.
17. Recording and Monitoring
We may record or monitor certain communications for training, quality assurance, security, compliance, or dispute handling.
Recording will occur only when permitted and after any required notice or consent.
Acceptance of these Terms does not replace consent required from participants in a recorded conversation.
Records may be retained for lawful business purposes and applicable retention obligations.
18. Personal Information
The relevant Privacy Policy explains how Sigma collects, uses, retains, discloses, and protects personal information.
Depending on the service, information may include contact details, application materials, qualifications, account activity, communications, and technical or security records.
Authorized providers may process information on our behalf for legitimate business purposes.
These Terms do not waive privacy rights that applicable law protects from waiver.
19. Cookies and Technical Tools
Our websites may use cookies, logs, analytics, authentication tools, and related technologies to support functionality, evaluate performance, improve services, maintain security, and prevent misuse.
Integrated third-party services may also collect technical information under their own practices.
Consult the applicable Privacy Policy for information about these technologies and available choices. Browser or device controls may allow you to limit certain tools, although doing so may affect website features.
20. Ownership and Permitted Use
Website text, designs, graphics, images, software, and other protected materials belong to a Sigma company, its licensors, or another identified rights holder.
You receive limited, revocable, nonexclusive, nontransferable permission to use the websites for lawful informational, employment, or authorized business purposes.
Website access does not transfer ownership of protected materials. Reproduction, modification, distribution, republication, or commercial exploitation requires authorization unless otherwise permitted by law.
Third-party marks remain the property of their owners.
21. Materials You Submit
You may provide forms, documents, messages, images, or other materials through approved features.
You represent that you have the right to submit those materials and that you are not knowingly violating the law or another person’s rights.
You authorize Sigma to receive, store, process, transmit, and use submissions as reasonably necessary to provide requested services, administer recruitment, meet legal obligations, and conduct legitimate business activities.
This permission does not transfer ownership of your existing intellectual property.
Use approved channels when providing sensitive information.
22. External Platforms and Links
Our services may connect to independently operated recruiting platforms, screening providers, verification tools, communication systems, and other websites.
Those services may have separate terms and privacy policies. We may not control their content, availability, security, or practices.
A link does not, by itself, represent endorsement. This section does not remove responsibilities imposed on Sigma for its own conduct or provider relationships.
23. Information Quality
We work to provide useful and accurate information, but website content may contain mistakes or become outdated.
We do not promise that every posting, schedule, qualification, description, or other statement is complete or current. Information may be corrected or updated in accordance with applicable law.
Confirm material details with the responsible Sigma company when necessary.
24. Availability and Security
We take reasonable steps to maintain our websites and safeguard information. Continuous availability and absolute security cannot be promised.
Maintenance, upgrades, network failures, security events, and other circumstances may interrupt access. We may introduce reasonable technical restrictions to protect users and systems.
Report suspected unauthorized account activity or security concerns promptly. If an incident requires legal notification, we will provide the required notices.
25. Website Warranties
To the fullest extent permitted by law, our websites and covered online services are provided “as is” and “as available.”
Where legally allowed, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
We do not guarantee uninterrupted access, error-free performance, or complete protection against security threats.
This section does not exclude warranties or protections that cannot lawfully be excluded.
26. Limits on Liability
To the extent permitted by applicable law, Sigma is not liable for indirect, incidental, special, punitive, or consequential damages resulting solely from use of, or inability to use, the covered websites or online services.
These limits do not restrict liability that the law does not allow us to exclude.
They do not eliminate protected employment rights, nonwaivable statutory remedies, or liability for fraud or intentional misconduct.
27. Informal Resolution of Disputes
Where legally permitted, the parties will first make a good-faith effort to resolve disputes relating to these Terms or the covered online services.
Send a written notice identifying:
- Your name and contact information.
- The Sigma entity involved, if known.
- The relevant service, submission, or transaction.
- The issue and the resolution requested.
Notices may be sent to:
Sigma Transport Holdings
Attn: Legal/Dispute Resolution
219 Main Street, Suite 300
Pittsburgh, PA 15215
Email: info@sigmacontinental.com
The parties will ordinarily allow 30 days after receipt of sufficient notice to attempt a resolution.
This process does not prevent urgent protective relief, preservation of filing deadlines, protected agency proceedings, or other actions permitted by controlling law.
28. Individual Arbitration Agreement
Acceptance and effect
If you affirmatively accept this arbitration agreement, you and the applicable Sigma entity agree to resolve covered disputes through final, binding individual arbitration when permitted by law.
An arbitrator generally decides those disputes instead of a judge or jury.
The agreement applies only when valid contractual acceptance exists and the dispute is legally eligible for arbitration.
Covered matters
Subject to the exceptions below, arbitration may cover disputes directly connected with:
- Covered website access and use.
- Online accounts and registration.
- Electronic submissions and website transactions.
- Interpretation or performance of these Terms.
- Eligible website communication disputes.
- Other online service matters expressly covered by the agreement.
Matters excluded
This website arbitration provision does not automatically cover:
- Claims that cannot lawfully be made subject to predispute arbitration.
- Qualifying transportation-worker claims exempt from the Federal Arbitration Act when no independently enforceable arbitration agreement applies.
- Sexual assault or sexual harassment disputes excluded under applicable federal law.
- Substantive employment disputes involving hiring, discrimination, pay, hours, retaliation, termination, workplace injuries, or benefits, unless a separate enforceable agreement expressly governs them.
- Workers’ compensation or unemployment proceedings subject to another required process.
- Government enforcement and protected administrative proceedings.
- Claims properly pursued in small claims court where this agreement does not require arbitration.
- Any other claim excluded by controlling law.
These Terms do not replace a separately executed employment arbitration agreement.
Applicable arbitration law
The Federal Arbitration Act governs where applicable. If it does not apply, arbitration may be required only under an independently valid agreement and applicable law.
Nothing here overrides a statutory arbitration exemption.
Administration and rules
The American Arbitration Association (“AAA”) will ordinarily administer eligible disputes under the applicable rules. Qualifying consumer matters will use the AAA Consumer Arbitration Rules; qualifying commercial matters may use the AAA Commercial Arbitration Rules.
Rules are available at adr.org.
If AAA administration is unavailable, the parties may select another neutral administrator or request an appointment through an authorized court process.
Arbitrator and remedies
Unless applicable rules or an enforceable agreement require otherwise, one neutral arbitrator will hear the dispute.
The arbitrator must apply governing substantive law and may award legally available individual relief. Nonwaivable remedies remain available.
Questions about formation or enforceability will be decided by a court when the law requires.
Location and format
The designated legal seat is Allegheny County, Pennsylvania, unless controlling law or binding arbitration rules require another location.
Proceedings may use remote hearings, written submissions, or another permitted format. No participant must attend a hearing at a location that is unlawful or unduly restrictive.
Costs
Fees and expenses will be allocated under the applicable rules and controlling law. Sigma will pay costs that those requirements assign to the Company.
No person will be required to pay fees prohibited by law as a condition of pursuing a claim. Attorney fees may be awarded when authorized by law, applicable rules, or another enforceable agreement.
Awards and review
Awards are binding to the extent provided by law. Applicable arbitration statutes govern court review, confirmation, and enforcement.
Right to opt out
You may decline this website arbitration agreement by sending an opt-out notice within 30 calendar days after your initial affirmative acceptance.
Include your identity and a clear statement that you are opting out of the website arbitration agreement.
Email info@sigmacontinental.com with the subject “Arbitration Opt-Out,” or mail your notice to the address in Section 27.
A timely opt-out does not affect your ability to apply or remain under consideration for employment. It does not change separate text messaging preferences.
29. Individual Proceedings and Class Waiver
Where lawful, claims covered by the arbitration agreement must proceed in each party’s individual capacity.
Neither party may pursue or participate in class, collective, consolidated, or representative arbitration of covered disputes unless applicable law prohibits that restriction.
An arbitrator may not combine separate individuals’ claims or conduct class arbitration without a legally valid basis.
This provision does not limit protected concerted activity, government proceedings, or other rights that cannot be waived.
If a restriction cannot be enforced for a particular claim or remedy, that issue will proceed in court as required by law. An unenforceable waiver does not, by itself, authorize class arbitration.
Other provisions remain effective only to the extent they can lawfully operate.
30. Governing Law
These Terms are governed by Pennsylvania law, without applying its conflict-of-laws principles, except where controlling federal law or another mandatory legal requirement applies.
The Federal Arbitration Act governs arbitration when applicable.
This choice of law does not remove nonwaivable rights or mandatory protections.
31. Courts and Venue
Subject to controlling law, court proceedings arising from these Terms that are not governed by enforceable arbitration must be brought in Allegheny County, Pennsylvania.
The selected courts are:
- State: Court of Common Pleas of Allegheny County, Pennsylvania.
- Federal: United States District Court for the Western District of Pennsylvania, Pittsburgh Division, when federal jurisdiction exists and assignment to that division is proper.
Where legally permitted, the parties consent to those courts’ personal jurisdiction and waive objections based solely on inconvenience.
This provision does not displace mandatory venue rules, jurisdictional requirements, protected agency proceedings, or other nonwaivable rights. Courts retain authority to apply governing procedural rules concerning assignment, transfer, and venue.
32. Jury Trial Acknowledgment
When a dispute is covered by a valid, enforceable arbitration agreement, the parties understand that an arbitrator will decide it instead of a judge or jury. Affirmative acceptance includes waiver of a jury trial for those covered claims.
This acknowledgment does not create a separate jury trial waiver for claims excluded from arbitration or when the arbitration agreement is unenforceable.
33. Protected Rights and Reporting
Nothing in these Terms prevents you from:
- Reporting suspected unlawful conduct.
- Filing or participating in government agency proceedings.
- Exercising rights before the Equal Employment Opportunity Commission or National Labor Relations Board.
- Raising wage, workplace safety, or transportation safety concerns.
- Making legally protected whistleblower disclosures.
- Seeking workers’ compensation or unemployment benefits.
- Engaging in protected concerted activity.
- Cooperating with law enforcement.
- Exercising another right that cannot lawfully be waived.
Protected reporting does not require Company permission.
34. Responsibility for Unlawful Misuse
Where permitted by law, a business user who knowingly engages in unlawful website activity, unauthorized access, or infringement may be responsible for legally recoverable losses directly caused by that conduct.
Applicants are not required to indemnify Sigma for ordinary application activity, good-faith disputes, protected reporting, or exercising statutory rights.
Sigma’s own legal compliance responsibilities are not transferred to applicants.
35. Restricting or Ending Access
We may change, suspend, restrict, or discontinue online features for legitimate operational, legal, technical, or security reasons.
Material violations may result in suspension or termination of access, subject to applicable law.
Ending website access does not automatically end employment or withdraw an application. Rights and obligations that lawfully arose before access ended may continue.
36. Accessibility
We seek to make our websites and application tools reasonably accessible.
If you encounter an access barrier or need a reasonable accommodation, contact info@sigmacontinental.com.
Requests will be considered under applicable legal requirements.
37. Access From Outside the United States
Our websites primarily support United States operations.
Visitors accessing them from other jurisdictions are responsible for laws applicable to their own conduct. Sigma remains responsible for privacy and data protection obligations applicable to its activities.
These Terms do not represent that every international privacy framework applies to every Sigma service. Additional notices or protections will be provided when required.
38. Updates
We may revise these Terms to reflect changes in services, operations, technology, or legal requirements.
The dates at the beginning identify this version. When required, we will provide notice of material changes or request renewed acceptance.
Changes to arbitration provisions will require additional assent where applicable law requires it.
Updating these Terms does not independently authorize additional marketing, calls, or text messages.
39. Severability
If a provision is found invalid or unenforceable, it may be limited or removed to the extent permitted by law. The remaining provisions continue only where they can operate lawfully and independently.
The specific rules addressing arbitration and class proceedings govern severability of those provisions.
40. Failure to Enforce
A party’s decision not to enforce a provision on one occasion does not automatically prevent later enforcement.
Waiving one violation does not necessarily waive another. Statutory deadlines and other mandatory requirements remain unchanged.
41. Transfers and Assignment
Where legally permitted, you may not transfer your account, access permissions, or contractual rights without authorization.
Sigma may assign rights and obligations in connection with a lawful merger, acquisition, restructuring, or asset sale, subject to applicable law.
A corporate assignment does not automatically transfer text messaging consent to another brand, company, or program.
Any continued use or transfer of communication consent must satisfy applicable requirements.
42. Relationship to Other Documents
These Terms and documents expressly incorporated into them govern the covered online services.
They do not replace employment agreements, required disclosures, handbooks, screening authorizations, or other valid agreements governing specific activities.
Controlling law takes priority. A specific enforceable agreement governing the relevant relationship or service controls over inconsistent general website provisions.
The applicable Privacy Policy separately describes personal information practices.
43. Reading These Terms
Headings help organize the document and do not independently determine its meaning.
“Including” and similar expressions introduce examples rather than complete lists.
References to laws include applicable amendments and controlling requirements. No provision requires unlawful conduct or surrender of a right that cannot legally be waived.
