Third-Party Cookies

Certain website features may involve cookies set or accessed by external service providers.

Some marketing emails may contain technologies that indicate whether a message was opened or a link was selected.

10.4 Cookie Controls

Individuals can manage cookies through available browser, device, or website preference controls.

Disabling certain cookies may affect the availability or functionality of website features.

Where applicable law requires consent for nonessential technologies, Sigma will provide appropriate consent mechanisms.

Where applicable law requires recognition of valid opt-out preference signals, Sigma will honor those signals as required.

10.5 Analytics and Session Monitoring

Sigma may use third-party analytics or usability services to evaluate visitor interactions.

If session recording or replay technology is used, its implementation must account for sensitive information, appropriate masking, applicable notice or consent requirements, and legal limitations on electronic monitoring.

Account and Security Communications

Messages containing verification codes, authentication notices, account alerts, and other security-related communications.

Job Opportunities and Promotional Communications

Optional messages relating to available positions, recruiting campaigns, or other promotional opportunities, where the individual has provided the required consent.

Consent to one program does not automatically authorize enrollment in unrelated messaging programs.

11.3 Consent to Receive Messages

Where required, Sigma obtains consent before sending messages.

Consent may be collected through a clearly identified website checkbox, electronic form, authorized enrollment process, or another legally sufficient method.

An optional marketing or recurring recruiting SMS checkbox will not be preselected.

Providing a telephone number alone does not automatically constitute consent to receive all categories of recurring or promotional messages.

Consent to receive optional SMS communications is not a condition of applying for employment, being hired, or purchasing goods or services.

11.4 Message Frequency

Message frequency varies according to the messaging program and the individual's activities.

Application-related messaging frequency may increase during interview scheduling, qualification screening, or onboarding.

Messages may be recurring. Sigma does not guarantee a fixed number of messages unless a specific program expressly establishes a limit.

11.5 Opt-Out — STOP

Individuals may withdraw consent to a recurring SMS program by replying STOP to the number from which the messages are received.

Sigma will process valid opt-out requests according to applicable law and messaging platform requirements.

A final confirmation message may be sent to acknowledge the opt-out.

Once an opt-out becomes effective, Sigma will not continue sending messages under the affected program unless a new legally sufficient authorization is obtained.

If Sigma operates separate messaging programs, an opt-out may apply to the specific program or sender associated with the request. Individuals may contact Sigma to request assistance with broader communication preferences.

11.6 Assistance — HELP

For assistance with SMS communications, reply HELP to the number sending the message.

Individuals may also contact:

Sigma Transport Holdings
Email: drivers@sigmatransport.com
Telephone: 412-924-8500

11.8 Mobile Information and SMS Consent Privacy

Sigma does not sell, rent, or share mobile phone numbers, SMS opt-in data, or text messaging consent information with third parties or affiliates for their independent marketing or promotional purposes.

Text messaging originator opt-in data and consent are excluded from any disclosures of personal information for third-party advertising, promotional marketing, or lead-generation purposes described elsewhere in this Policy.

Sigma may disclose information to authorized messaging platforms, telecommunications carriers, aggregators, and service providers solely as reasonably necessary to deliver messages, manage consent, maintain records, support communication services, and comply with applicable law.

These records may be used to manage communications, document consent, comply with messaging requirements, resolve disputes, and investigate unauthorized messaging.

11.10 Changes in Telephone Number

Individuals should notify Sigma if their telephone number changes or if they are no longer authorized to receive messages at a registered number.

Sigma may use reasonable procedures to identify reassigned or invalid telephone numbers and update messaging records.

11.11 Message Delivery and Security

Text messages may be transmitted across telecommunications networks not controlled by Sigma.

SMS is not necessarily an encrypted or confidential communication channel.

Recipients should avoid submitting Social Security numbers, account passwords, medical records, or other highly sensitive information through ordinary text messages unless specifically directed to an approved secure process.

Mobile carriers are not responsible for delayed or undelivered messages.

11.12 Withdrawal of Consent

Withdrawing consent for optional messaging will not automatically terminate an employment application, employment relationship, or other business relationship.

Sigma may communicate through another lawful and appropriate channel when necessary.

Withdrawal of optional SMS consent does not eliminate communications separately authorized or required by applicable law.

12. Email and Electronic Communications

Sigma may communicate through email for recruiting, business services, employment administration, account security, operational notifications, and other legitimate purposes.

Recipients of optional promotional emails may unsubscribe using the instructions provided in those communications or by contacting drivers@sigmatransport.com.

Unsubscribing from promotional emails may not prevent legally required, transactional, operational, employment-related, or security communications.

Sigma may maintain communication records to document business transactions, employment matters, and compliance requirements.

13. Disclosure of Personal Information

Sigma may disclose personal information when reasonably necessary for legitimate business activities or as permitted or required by applicable law.

13.1 Affiliated Sigma Companies

Personal information may be shared among Sigma Companies to support centralized administration, authorized recruiting activities, workforce management, safety oversight, accounting, technology infrastructure, and other legitimate corporate functions.

Personal information may be disclosed where required or legally permitted in response to:

  • Court orders and subpoenas.
  • Regulatory inspections.
  • Government investigations.
  • Transportation safety requirements.

Personal information may be evaluated or transferred in connection with a merger, acquisition, financing, reorganization, asset sale, business sale, or similar transaction, subject to applicable legal requirements.

13.10 Protection of Rights and Safety

Sigma may disclose information when reasonably necessary and legally permitted to investigate misconduct, prevent fraud, protect individuals, preserve evidence, enforce legal rights, or address threats to safety.

14. Selling, Sharing, and Targeted Advertising

Privacy laws may distinguish between the disclosure of personal information to a service provider and the sale or sharing of information for other purposes.

A disclosure may qualify as a “sale” under certain state laws even when no money is exchanged.

Likewise, disclosure of identifiers or website activity to an advertising network for cross-context behavioral advertising may constitute “sharing” under California law.

Sigma's authorized disclosure of information to a service provider for a contracted business function does not necessarily constitute a sale.

Sigma will evaluate its advertising, analytics, data-sharing, and affiliated-company practices under applicable law.

Where Sigma engages in processing that legally qualifies as a sale, targeted advertising, or cross-context behavioral advertising and an opt-out right applies, Sigma will provide the required method to exercise that right.

SMS opt-in information and consent are not shared with third parties or affiliates for their independent marketing or promotional purposes, regardless of the other disclosures described in this section.

15. Third-Party Websites and Services
